By accepting this agreement upon ordering, you, the firm you represent, the property owner or property representative/REO Broker, (Client), agree to pay Total Tax and Lien Searches, LLC (TTLS) the notified rate plus any and all municipal fees or third party fees for all searches. If a real estate transaction does not close with a particular client it does not constitute a wash. A wash is defined as a bank file that has been cancelled with your company and the property does not close. If the file has been removed from your office to close elsewhere, you will be responsible for 100% of the invoiced fees and costs. You will make every effort to inform TTLS of the new title company and TTLS will reduce your invoice by any amounts collected from the new company. If TTLS cannot determine the new title company within 60 days of the cancellation, you will be invoiced the full amount payable within 10 days. If the property closes within the 60 days and TTLS has not been paid from the new company, you will be invoiced the full amount payable within 10 days.
A wash does not include a cancelled contract that will be searched at a future time under a different buyer or any file contracted for the purposes of a direct purchase or for the purpose of analyzing a property for speculative purposes. Any additional searches on this particular parcel/folio will be charged at the contracted rate and previous search fees and costs attached to the new invoice. Client agrees to pay TTLS for all services including any third party or municipal fees at the closing of the real estate transaction or within 90 days of last work provided for the requested parcel/folio. The wash of invoices are not to exceed 5% of ordered searches within any 60 day period. All invoices in excess of the 5% wash limit to be paid immediately or upon account reconciliation. Requests submitted and processed as rushes or in error by client such as wrong address or incorrect parcel/folios will not be included in wash agreement and will be due in 30 days. For a wash to be valid, the client must contact us within 1 business day following any knowledge of the cancellation of contract. Client is responsible to reimburse TTLS any and all third party or municipal fees regardless of a wash, closing or cancellation.
Any termination of a business relationship by a Client and TTLS, by either party, will make payable all invoices from TTLS due within 10 days of termination of the relationship.
A full lien search includes the following: Real Estate Property & Tangible Taxes, Lien letters, Special Assessments, Code Enforcement Violations, Open/Expired Permits, & Municipal Utilities. Refuse/trash collection fees may be omitted in certain situations due to lack of a sole collector in a certain jurisdiction.
The following information is NOT included: Recorded Liens, HOA/Condo Estoppels, Zoning Verification Letters, Certificate of Occupancy, Payoffs on Recorded/Unrecorded Liens.
Searches are a result of information provided by the County Property Appraiser, County Tax/Revenue Collector, County/City Water and Sewer Authority, County/City/or Private Solid Waste Authority, and County/City Permit and/or Code Departments. Searches do not include any liens or pending liens, whether recorded or otherwise, as to any outstanding balance due any taxing/lien authority not specifically referenced above. In the event that any information on the final lien report is incorrect or not current, TTLS assumes no liability for damages incurred directly or indirectly as a result of incomplete, incorrect or omissions of information received from any municipality or private company who deliver the information requested to TTLS. Furthermore, TTLS assumes no liability for damages incurred directly or indirectly as a result of incomplete, incorrect or omissions of information received from the client including wrong addresses or incorrect folio/parcel.
We furthermore make no warranty for a timely turnaround of information due to municipal and private company response times (most cities/counties may have increased their turnaround times due to the state of the real estate market, cutbacks in staff, and the numerous requests received. Also, most cities/counties may take longer on properties that might have violations/liens as they need to gather the most accurate and current information), Acts of God, natural disaster or military conflict/war. However, we will make our best effort to meet your timeframe.
